BELRIM members and guests gathered on Thursday 19 March at the law firm Linklaters to listen to a very interesting and rich exhange about class actions. A new Belgian legislation has been voted and is in force in Belgium regarding class actions (action en réparation collective/rechtsvordering tot collectief herstel).
Florence Danis and Françoise Lefèvre, respectively managing associate and partner at Linklaters, took the time to explain in detail the context of the new law: what are the objectives? who can introduce a class action? on which grounds? Which are the different milestones during the procedure?
Advice was also given about how to be prepared for and to react to a class action.
The second part of the exchange covered the economic aspects of a class action in the US and in Canada (Marc Van Audenrode). Closing the presentation, Benoît d’Udekem shed some light on trends around class actions in Europe where countries like France, Italy or the Nordic states already encountered court procedures in that respect.
A cocktail reception put the final touch to the exchange.
